So I figured out why I'd never heard the term "riparian rights": Kansas is a prior appropriation state. What little water law background knowledge I had was based on that theory.

whoa, that was actually in your BarBri course? I was just joking. I don't remember dealing with water law at all for the bar.
The appropriation states are the ones where it matter, though, right? The states with actual water supply issues, IIRC.

yeah, the dry ones.
And it was "in" our course for about 5 minutes at the end of the real property lecture, and about 2-3 pages of the multistate outline.
And yeah, we just covered it today. I was amused since before you mentioned it yesterday I'd never heard of riparian rights.
