Is it YouTube's policies? I thought it was the DMCA that obligated them to comply with takedown notices and put the burden on the uploader to challenge it in court.

A really good point he makes is that people are focusing almost entirely on how this affects LPers (ourselves and myself included in this discussion), but the program actually prevents reviewers from showing gameplay as well. Which is just ridiculous. There's at least some room for argument over whether LPs are actually fair use or not, but reviews certainly are and Nintendo unquestionably has no legal right or authority to block those.

I wouldn't like that method for anything longer than FTL. I'd prefer it not to delete the save when you load, just because the power might go out or something. What I'd prefer is that it just delete your saves when you die/get spotted/whatever, so if you fail you still can't load them up. -

Yeah, I played that Friday and basically completely agree. From the trailers and stuff I'd been a little worried about the dialog, but apparently basically all the bad parts of it were in the trailers, so like you said for the most part it was great.

Don't a lot of these people get hired by bigger companies who actually would be able to sue? Yes, but it's still easier to just make LPs of different games. I doubt any company sees making LPs of Nintendo games as so critical to its profits that it's worth the expense of a lawsuit about it. I'm sure it will happen eventually, but generally speaking the incentives just aren't there.

The LP itself is a new creation that, while not entirely independent of the original work (the game), is transformative and legally distinct. It's owned by the LPer. If you repost that LP somewhere else then you are in violation of the LPer's copyright, just like you would be in violation of the developer/publisher's copyright if you uploaded the actual game to a torrent site.

Because that's expensive and it's easier to just make LPs of different games. *Edit* - And because of the fucked-up way the DMCA is set up, it puts the burden on the supposed transgressor to sue. All Nintendo has to do is issue a takedown notice to Youtube and Youtube has to take the shit down unless the person who put it up starts a lawsuit to challenge it, whereas in the analogy I made above the burden would be on Nintendo to sue the newspaper to try to get them to pay up or stop publishing the stuff. This set up really encourages frivolous/borderline claims, because there's basically no downside.

Except that's a terrible analogy. Nintendo is producing games. LPers are not delivering games, they are delivering visual/audio recordings of those games along with commentary on them. What is happening here is Nintendo is making food, LPers are taking pictures of that food and putting them in the newspaper along with their thoughts as they consume the food, and Nintendo is demanding a cut of the newspaper's advertising revenue. LPers have a legal right to produce, distribute, and profit from their content, and Nintendo has no right to stop them, or to demand a cut. Nonetheless, they issue takedowns, and then say that they'll generously allow you to do something they have no right to stop you doing, if only you'll agree to do it the way they want and to give them a cut.

This. In the US fair use allows you to redistribute work, even for profit, as long as that work is somehow transformed by your additions/modifications/commentary. It's more complicated than that, as most things are, but that's the gist of it. The problem is that the person having their shit taken down has to have the resources to be able to challenge that, and Nintendo still has lots of money for lawyers. Now something they almost certainly would have the right to have taken down would be cutscene uploads, since those are more like a movie and just the straight copyrighted material with no modification. As a purely news source, I find Polygon News to be a good replacement for Joystiq. Just make sure to go to the news section to eliminate all editorials/opinion pieces. The layout is not bad too. I'm not crazy about horizontal layouts, i prefer to just scroll down and not make me repeatedly move my eyes left-right, but this one's workable. At least everything's aligned, unlike, say Ars Technica's or The Verge's layout.

Just played the first episode and it did not disappoint. Coincidentally, after the credits it shows a little teaser for Episode 2 and says it's coming March 2015.

Well considering they very likely don't actually have the legal right to issue takedowns in the first place, it's pretty shitty. It'd be like saying the mob charging you 30% for protection is fine because it's better than them just not letting you have your business at all.
